USCIS to Update Policy Guidance for International Students
USCIS has announced that it is issuing policy guidance regarding the F and M student nonimmigrant classifications.
This guidance will consolidate existing policy and provide clarity to international students and U.S. educational institutions on various topics, including eligibility requirements, school transfers, practical training, and on- and off-campus employment.
Among the most notable changes, the guidance will clarify that F and M students may be the beneficiary of a permanent labor certification application (PERM) or immigrant visa petition (I-140 petition). In other words, undergoing the permanent residency process will not preclude F and M students from demonstrating their intention to depart the U.S. after completing their education and training.
