USCIS to Resume Bundled Processing of Applications for H and L Dependents
Effective January 25, 2023, USCIS will bundle the processing of I-539 and I-765 (EAD) applications for spouses and children of H-1B and L-1 nonimmigrants along with the I-129 petition. Bundled processing will apply to cases filed under both regular and premium processing. This means if the H-1B or L-1 petition is filed with a request for Premium Processing, the I-539 (and I-765 if filed) will enjoy premium processing as well. However, it is important to note that processing will only be bundled if the petitions/applications are filed concurrently.
Background: Premium processing provides expedited processing for I-129 petitions for an additional fee of $2,500. Specifically, USCIS guarantees it will take adjudicative action on a premium processing H/L case within 15 calendar days. Premium processing is currently unavailable for standalone I-539 and I-765 applications.
